UC/LOCAL 501 SIDE LETTER AGREEMENT
REVISIONS TO CASUAL EMPLOYMENT POLICIES
This side letter deals with the review of employment of employees who are currently in casual appointments. If there is any conflict between specific Articles (such as Casual Employees, Probationary Period) of the UC/Local 501 Memorandum of Understanding and this side letter, as of the effective date of this Side Letter, the intent and terms of the side letter will supercede the specific language of those Articles only to the extent they are in conflict. (The effective date of the Side Letter will be the date of the final signature of the parties to the Execution of Agreement of the UC/Local 501 Memorandum of Understanding.) Terms and conditions not specified herein will not change.
- Employment
On the effective date of this Side Letter, the University will establish a new type of staff appointment for temporary employment of Skilled Crafts employees - the Limited Appointment - which replaces the former “Casual” appointment category. A Limited appointment is defined as one during which the employee is expected to be on pay status for less than 1,000 hours in a 12-month period. As of the effective date of this Side Letter, bargaining unit employees in casual appointments will be changed to Limited Appointment status.
An employee in a Limited Appointment will become eligible for conversion to a Career appointment if he or she remains on pay status beyond 1,000 hours and does not have a break in UC service greater than 120 consecutive days. A Limited appointment employee is eligible for conversion to Career appointment, effective on the first of the month after meeting these conditions.
Time on pay status (rather than time actually worked) in Limited appointments during a period of 12 consecutive months, beginning with the effective date of this Side Letter, counts towards Career appointment eligibility. For this purpose, time on pay status includes sick leave, extended sick leave, vacation, compensatory time off, military leave with pay, administrative leave with pay, and holidays. Overtime, on-call hours, call back, and time in Casual/Restricted or Contract appointments do not count towards the 1,000-hour threshold for conversion to Career status.
- UCRP Membership
A Skilled Crafts employee in a Limited appointment will become a University of California Retirement Program (UCRP) member after accumulating 1,000 hours on pay status during a consecutive 12-month period. UCRP membership will be effective no later than the first of the following month after an employee reaches the 1,000-hour threshold.
Employees who enter UCRP under this provision will enjoy all the benefits of UCRP membership. UCRP provides retirement income for eligible employees as well as disability and death benefits. In addition, because eligibility for health and welfare benefits is based in part on UCRP membership, employees who enter UCRP under the new provisions will also be eligible for health and welfare coverage, including the medical, dental, vision, disability, and life plans. Employees are eligible for University benefits and membership in the University’s retirement plan in accordance with the plan’s eligibility requirements as described in the plan documents/contracts, applicable regulations and policy announcements and pursuant to Article 44 (Health & Welfare & Retirement Benefits). (Note: Skilled Crafts employees in casual appointments became eligible as members of UCRP under this new policy as early as July 1, 2001. The counting of hours for eligibility in UCRP was effective with the January 2001 payroll cycles.)
- Changes to UC/Local 501 Memorandum of Understanding
Changes are proposed in the following Articles of the UC/Local 501 Memorandum of Understanding (see attachment).
Article 6 Casual Positions (Proposed redefinition of Casual to “Limited Appointment”)
Article 5 Probationary Period (Proposed crediting of up to 1,000 hours of qualified limited appointment time toward career probationary period.
