Court Denies Union's Request for Unrestricted Leafleting of UC Medical Centers
On Thursday, March 13, Alameda County Superior Court Judge David Hunter denied the request of the American Federation of State, County and Municipal Employees union for a preliminary injunction. The union requested the injunction in order to bypass long-standing access policies at UC San Francisco and UCLA medical centers for the purpose of distributing union leaflets.
On February 14, AFSCME was granted a temporary restraining order that allowed the union specific access to university medical centers at UC San Francisco and UCLA in order to distribute union leaflets. The temporary restraining order remained in place until the denial of the union's request for a preliminary injunction which sought continued additional access to the medical centers.
UC filed an unfair practice charge with the Public Employment Relations Board against AFSCME on February 20 alleging that AFSCME had unilaterally and unlawfully repudiated the parties long-standing agreement regarding access to the medical centers. UC believes the union s actions demonstrate a failure to bargain in good faith, a refusal to participate in impasse procedures in good faith, and a disregard for patients and their families visiting the medical centers.
